Through the NM Legal Resource Group, LLC, you will have the opportunity to obtain personal service and advice of lawyer. You will also have the option to maintain your own legal library on each of the documents you prepare. Note that RoybalMackLaw.DivorceNM.com is not a law firm or an attorney, and you will need to consult with an attorney should you desire direct legal representation. At any time, you can seek mediation services to resolve the matter. With RoybalMackLaw.DivorceNM.com, you will be able to schedule sessions with an experienced mediator to sit with you and the other party to explore the settlement of the matter. Why spend a small fortune paying for attorney’s fees when you can handle your case on your own? License to Use. RoybalMackLaw.DivorceNM.com grants you a limited, personal, non-exclusive, non-transferable license to use our forms (the “Forms”) for your own personal use, or if you are an attorney or professional, for your client. Except as otherwise provided, you acknowledge and agree that you have no right to modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit any of the Forms in any manner, except for modifications in filling out the Forms for your authorized use. References to “RoybalMackLaw.DivorceNM.com”, “you”, “we,” and “us” include our respective subsidiaries, affiliates, agents, employees, predecessors in interest, successors, and assigns, as well as all authorized or unauthorized users or beneficiaries of services or devices under this or prior agreements between us. You and RoybalMackLaw.DivorceNM.com each understand that it is possible there will be occurrences that no one anticipated. It is also possible that times may come when we find ourselves in disagreement in connection with your use of the Site, Services and/or Applications. If something unanticipated happens or if we find ourselves in disagreement, both you and RoybalMackLaw.DivorceNM.com agree that we are committed to avoiding adversarial proceedings of any kind and to seeking instead a system for collaborating to bring whatever transformation will best serve the needs of all. Accordingly, if we find ourselves in disagreement, you and RoybalMackLaw.DivorceNM.com each commit to dedicate our efforts towards bringing ourselves back into agreement as quickly as possible by talking together honestly, openly, in good faith, and with a commitment to a sense of fairness for all involved. Most customer concerns can be resolved quickly and to the customer’s satisfaction by emailing our customer service department at support@RoybalMackLaw.DivorceNM.com. In the unlikely event that our customer service department is unable to resolve a complaint you may have (or if RoybalMackLaw.DivorceNM.com has not been able to resolve a dispute it has with you after attempting to do so informally), we each agree to resolve those disputes through small claims court, or binding arbitration, instead of in courts of general jurisdiction. 11. Dispute Resolution By Binding Arbitration: RoybalMackLaw.DivorceNM.com and you agree to arbitrate all disputes and claims between us that have not been settled through informal discussion or in small claims court (the “Arbitration Agreement”). This agreement to arbitrate is intended to be broadly interpreted. It includes, but is not limited to:

  • claims arising out of or relating to any aspect of the relationship between us, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory;
  • claims that arose before this or any prior agreement (including, but not limited to, claims relating to advertising);
  • claims, if any, that are currently the subject of purported class action litigation in which you are not a member of a certified class; and
  • claims that may arise after the termination of this Agreement.

Any arbitration under this Agreement will be governed by the AAA rules and will take place on an individual basis; class arbitrations and class actions are not permitted. Notwithstanding the foregoing, either party may bring an individual action in small claims court. This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies, including, for example, the Federal Communications Commission. Such agencies can, if the law allows, seek relief against us on your behalf. You agree that, by entering into this Agreement, you and RoybalMackLaw.DivorceNM.com are each waiving the right to a trial by jury or to participate in a class action. This Agreement evidences a transaction in the interstate commerce, and thus the Federal Arbitration Act governs the interpretation and enforcement of this provision. This arbitration provision shall survive termination of this Agreement. A party who intends to seek arbitration must first send to the other, by certified mail, a written Notice of Dispute (“Notice”). The Notice to RoybalMackLaw.DivorceNM.com should be addressed to welcome@RoybalMackLaw.DivorceNM.com (“Notice Address”). The Notice must (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought (“Demand”). If RoybalMackLaw.DivorceNM.com and you do not reach an agreement to resolve the claim within sixty (60) calendar days after the Notice is received, you or RoybalMackLaw.DivorceNM.com may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by RoybalMackLaw.DivorceNM.com or you shall not be disclosed to the arbitrator until after the arbitrator determines the amount, if any, to which you or RoybalMackLaw.DivorceNM.com is entitled. The arbitration will be governed by the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (collectively, “AAA Rules”) of the American Arbitration Association (“AAA”), as modified by this Agreement, and will be administered by the AAA. The AAA Rules are available online at adr.org, by calling the AAA at 1-800-778-7879, or by writing to the Notice Address. The arbitrator is bound by the terms of this Agreement. All issues are for the arbitrator to decide, including, but not limited to, issues relating to the scope, enforceability, and arbitrability of the arbitration provision. Unless RoybalMackLaw.DivorceNM.com and you agree otherwise, any arbitration hearings will take place in a reasonably convenient location for both parties with due consideration of their ability to travel and other pertinent circumstances. If the parties are unable to agree on a location, the determination shall be made by AAA. If your claim is for $10,000 or less, we agree that you may choose whether the arbitration will be conducted solely on the basis of documents submitted to the arbitrator, through a telephonic hearing, or by an in-person hearing as established by the AAA Rules. If your claim exceeds $10,000, the right to a hearing will be determined by the AAA Rules. Regardless of the manner in which the arbitration is conducted, the arbitrator shall issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the award is based. The payment of AAA filing, administration, and arbitrator fees for any arbitration initiated in accordance with the AAA Rules will be governed by the AAA rules. The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees and expenses at any time during the proceeding and upon request from either party made within 14 days of the arbitrator’s ruling on the merits. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. YOU AND ROYBALMACKLAW.DIVORCENM.COM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and RoybalMackLaw.DivorceNM.com agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void. Notwithstanding any provision in this Agreement to the contrary, we agree that if RoybalMackLaw.DivorceNM.com makes any future change to this arbitration provision (other than a change to the Notice Address) during your Membership, you may reject any such change by sending us written notice within thirty (30) calendar days of the change to the Arbitration Notice Address provided above. By rejecting any future change, you are agreeing that you will arbitrate any dispute between us in accordance with the language of this provision. The provisions of this section 11 may be enforced by any Court of competent jurisdiction, and the party seeking enforcement shall be entitled to an award of all costs, fees and expenses, including reasonable attorneys’ fees, to be paid by the party against whom enforcement is ordered. 12. Limitation of Term of Action. You agree that any cause of action related to or arising out of your relationship with RoybalMackLaw.DivorceNM.com must commence within ONE year after the cause of action accrues. Otherwise, such cause of action is permanently barred. 13. Termination/Access Restriction RoybalMackLaw.DivorceNM.com reserves the right, in its sole discretion, to terminate your access to the RoybalMackLaw.DivorceNM.com Site, Applications, and the related services or any portion thereof at any time, without notice. 14. Additional Terms Some RoybalMackLaw.DivorceNM.com Services or Applications may be subject to additional posted guidelines, rules, or Terms of Use (“Additional Terms”) and your use of such Services or Applications will be conditioned on your agreement to the Additional Terms. If there is any conflict between these Terms of Use and the Additional Terms, the Additional Terms will control for that Service, unless the Additional Terms expressly state that these Terms of Use will control. 15. Reviews, Comments, Communications, and Other Content. At various locations on the Site or through Applications, RoybalMackLaw.DivorceNM.com may permit visitors or other third parties to post ratings, reviews, comments, blogs, and other content (the “User Content”). Contributions to, access to and use of the User Content is subject to this paragraph and the other terms and conditions of these Terms of Use. 16. Rights and Responsibilities of RoybalMackLaw.DivorceNM.com RoybalMackLaw.DivorceNM.com Is Not Responsible For and Does Not Necessarily Hold the Opinions Expressed by Content Contributors. Opinions and other statements expressed by users and third parties (e.g. bloggers) are theirs alone, not the opinions of RoybalMackLaw.DivorceNM.com. User Content is the sole responsibility of the third parties and its accuracy and completeness are not endorsed or guaranteed by RoybalMackLaw.DivorceNM.com. You acknowledge that by providing you with the ability to view and/or distribute content through our site, RoybalMackLaw.DivorceNM.com is not undertaking any obligation or liability relating to the content. RoybalMackLaw.DivorceNM.com and its affiliates, successors, assigns, employees, agents, directors, officers and shareholders do not undertake or assume any duty to monitor the RoybalMackLaw.DivorceNM.com Site for inappropriate or unlawful content. RoybalMackLaw.DivorceNM.com, its affiliates, successors, assigns, employees, agents, directors, officers and shareholders assume no responsibility or liability which may arise from the content thereof, including, but not limited to, claims for defamation, libel, slander, infringement, invasion of privacy and publicity rights, obscenity, pornography, profanity, fraud, or misrepresentation. Notwithstanding the foregoing, RoybalMackLaw.DivorceNM.com reserves the right to block or remove communications, postings or materials at any time in our sole discretion. If you have reason to believe system security has been breached, contact us by email for help. If the RoybalMackLaw.DivorceNM.com technical staff suspects a user identity or login is being used by someone who is not authorized by the proper user, RoybalMackLaw.DivorceNM.com may temporarily disable that user’s access in order to preserve system security. In all such cases, RoybalMackLaw.DivorceNM.com will contact the RoybalMackLaw.DivorceNM.com Client as soon as feasible. RoybalMackLaw.DivorceNM.com has the right (but not the obligation), in our sole and absolute discretion, to edit, redact, remove, re-categorize to a more appropriate location or otherwise change any User Content. 17. Rights and Responsibilities of RoybalMackLaw.DivorceNM.com Users or Other Posters of User Content. You are legally and ethically responsible for any User Content – writings, files, pictures or any other work – that you post or transmit using any RoybalMackLaw.DivorceNM.com service that allows interaction or dissemination of information. In posting User Content, you agree that you will not submit any content:

  • that is known by you to be false, inaccurate or misleading;

  • that is, or may reasonably be considered to be, defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing, or advocates or encourages illegal conduct harmful to any individual, partnership or corporation.   • that includes advertisements, spam, or content for which you were compensated or granted any consideration by any third party;
  • that includes information that references other websites, addresses, email addresses, phone numbers, or other contact information;
  • that contains any computer virus, worms, or other potentially damaging computer programs or files;
  • that otherwise violates these Terms of Use.

Attorneys that submit User Content and provide advice do so at their own risk. Under United States federal law, you retain copyright on all works you create and post as User Content, unless you choose specifically to renounce it. In posting a work as User Content, you authorize others who have access to that service to make personal and customary use of the work, including creating links or reposting, but not otherwise to reproduce or disseminate it unless you give permission for such dissemination. You grant RoybalMackLaw.DivorceNM.com a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from, sell, distribute, and/or incorporate such content into any form, medium, or technology throughout the world without compensation to you. You have the right to remove any of your works from User Content at any time. 18.   1. Your physical or electronic signature;
